The situation
Mrs E used our Firm to create and update her Will when she no longer wanted to leave anything to her daughter. After she died her son, Mr F became the executor of the estate.
The problem
When Mr F came to apply for the grant of probate, he discovered his sister, Miss T had stopped the probate. She had done this by placing a caveat at the Probate Registry. Mr F requested our assistance in the process of “warning off” his sister.
The outcome
We assisted Mr F by writing to his sister and requesting that she remove the caveat or provide a detailed letter of claim. Miss T believed their mother’s will was invalid however from our firm’s detailed attendance notes, he was able to defend this, and the caveat was removed. Mr F was then able to obtain probate and deal with the Estate.
