In light of the recent list of Kettering employers who have failed to meet minimum wage standards businesses should be reminded not to inadvertently breach the National Minimum Wage (NMW) Regulations. This could be failing to pay staff the NMW itself, or other breaches such as:

  • Wrongly deducting pay from workers’ wages, such as for uniform and expenses;
  • Failing to pay workers for all the time they worked, such as overtime;
  • Failure to pay workers for any time spent training; or
  • Failing to pay workers for any travelling time.

Under the Naming Scheme, HMRC has the ability to publish a list of those guilty employer’s who have failed to meet the NMW Regulations and specify the breaches they are guilty of.

This can have unfavourable affects on both the reputation of a business as well as staff morale.
