Practice Guide 19 clarifies requirements for conveyancer’s certificate relating to Form LL restriction

Safeguarding against fraudulent disposals of your property.

If a private individual wishes to safeguard against a fraudulent disposal of their property (such as where property is empty or tenanted), and the property is registered at the Land Registry, they can apply for the entry of a restriction on the title in Form LL.

When a document is submitted for registration, this restriction requires a conveyancer’s certificate that the person who executed the document as disponor is indeed the proprietor.

Where a property is owned by a company, no standard form of restriction exists. However a non-standard restriction may be applied for, requiring a conveyancer to certify that the disponor is the same company as the proprietor. The restriction can also require a certificate that reasonable steps have been taken to ensure that anyone who executed a deed on the company’s behalf held their stated office at the time of execution.
