COVID19 screening and children – your rights
Reasons to choose Wilson Browne
In these still very uncertain times I have been instructed by the parents of a 10 year old child who asked me if she could be screened for Covid and assessed for Coronavirus without reference to them. I think this is probably the first time I have ever been instructed in relation to issues arising from a pandemic.
The reassurance I was able to give to my clients was that on 12th August 2020 the Children’s Commission for England had confirmed that a parent, carer or legal guardian has to be present for a screening to take place and that a Public Health Officer does not have the power to screen and assess without a parent or carer present. Only in extremely rare cases can a Public Health Officer decide who is the most appropriate adult to be present for a screening. At no point will a child be screened without the appropriate adult present.
Wilson Browne have a team of family lawyers to assist in any concerns you may have in respect of your children, particularly relating to arrangements for children following separation of divorce when often emotions are running very high and it is not always possible for parents to reach an agreement between themselves. Often just some guidance is all that is required to assist parents to subsequently reach their own agreement.
