Launch of National Archives Find Case Law Website Hosting Court & Tribunal Judgments

On 19 April 2022, the Ministry of Justice (MoJ) and HM Courts & Tribunals Service (HMCTS) announced that new court and tribunal decisions from the UK Supreme Court, the Court of Appeal, the High Court and the Upper Tribunals are now available on The National Archives (TNA) Find Case Law website here – https://caselaw.nationalarchives.gov.uk/.

Moving forward, TNA will work with the MoJ and the judiciary to expand coverage of what is published and made accessible to the public, including judgments from the lower courts and tribunals. TNA will actively acquire and migrate legacy judgment and tribunal decisions, and judgments held on government websites will be relocated to widen its coverage as far as possible.

James Cartlidge, the Justice Minister, has described the launch of the TNA Find Case Law website as “a vital step towards better transparency”, which will “ensure court judgments are easily accessible to anyone who needs them”.

Dr Natalie Byrom, Director of Research at the Legal Education Foundation, noted: “for the first time, the retention and preservation of judgments from courts and tribunals in England and Wales is guaranteed under primary legislation, as is the right for the public to obtain access to these documents”.
