From 1 April 2018 the new minimum energy efficiency standards (“MEES”) will apply to leases of all non domestic properties, even lease renewals.
The new minimum rating will be set at an E EPC rating. From 1 April 2023 the standards will also apply to any leases already then in place. Short term (6 months or less) leases and long (99 years or more) leases will be exempt, as will properties exempt from the EPC regime.
It is therefore important that landlords start thinking now about the ratings of their properties and consider carrying out sooner rather than later any works necessary to bring them up to the minimum standard. Where already let it may be difficult to have the necessary access to the property to carry out any works, or even to have an EPC prepared.
