What does a new-build conveyancer do?

As a buyer, you may have to exchange contracts without seeing the actual house you are buying, while property developers often rely on solicitors to exchange contracts within 28 days of an offer being accepted. This is where a specialist new-build conveyancer or solicitor can help.

How does the new-build conveyancing process work?

A team of new-build conveyancing solicitors is often vital for ensuring you’ve submitted the necessary legal paperwork within the short, stringent timeline. Not all solicitors or conveyancers offer new-build services, so we recommend doing your research and selecting an experienced conveyancing solicitors before making an offer on a new-build.

Reserve the property

If you’re keen to stop the new-build from being snapped up by another viewer, you’ll be asked to pay a non-refundable reservation fee (anywhere between £500 to several thousands of pounds) before making an offer. However, this fee will be deducted from the final price and allows you to reserve the property for 28 days.

Arrange your mortgage

A mortgage is essential for many buyers, so it’s worth exploring mortgage lenders early on and obtaining an Agreement in Principle before you even make an offer on a property. Once your offer has been accepted, however, you’ll need to obtain a confirmed mortgage offer letter based on the value of the new-build property.

Conduct conveyancing checks

It’s essential that your solicitor carries out the relevant conveyancing searches including planning permission checks, local authority searches, title deed checks, and a search to see whether the property is covered by the new-build guarantee.

These searches are designed to highlight any potential issues that could impact the value of the property.

Find a surveyor

Despite being a new-build, you should still contact a surveyor to create a snagging list. While most new-build properties will come with a ten-year NHBC warranty (for protection against any structural defects), it’s also wise to ask a snagging surveyor to conduct an inspection of the finish and any damage.

Exchange contracts

At this point, you’ll be asked to pay the deposit (typically between 5-10%) and exchange contracts with the developer to make the transaction legally binding.

Complete

The final step is to set a completion date which is the date that you (or your mortgage lender) pay the property balance. A date to complete is normally set 10 days after the contracts have been exchanged, but this isn’t always the case.

On this date, your solicitor or conveyancer will fill in all the necessary documentation to transfer legal ownership of the property to you and you’ll be given the keys to the new-build and can begin moving in.
